Landlord Tenant

Forsyth, Howe, O'Dwyer, Kalb & Murphy, PC represents a wide range of both residential and commercial landlords in issues ranging from lease drafting and negotiation to eviction proceedings.

Although we have traditionally limited our eviction practice to upstate New York, we handle post foreclosure evictions on a state wide basis.

Our eviction practice includes the drafting of petitions, scheduling with the appropriate courts; coordination of service of process, court appearances, coordination of lock outs with the sheriff or marshal’s office and post judgment collection efforts.

From our experience, a properly drafted lease is a key factor in the ability of the landlord to recover amounts due, remove problem tenants and collect the legal fees and costs associated with the eviction process. We also think it essential that landlords prescreen tenants by documenting ability to pay and checking references prior to leasing.

We are available to provide assistance to our clients in both of these areas.

Although we typically represent landlords, we are also often called upon to represent tenants. Although it is typically difficult to get around an inability to make agreed payments, there are often mitigating factors that allow us to negotiate additional time periods to vacate or a decrease in the amount that must be paid the landlord.
